Know your rights

Learn how to assert your claims correctly.

Do you know your rights after an accident?

After a car accident, as the injured party, you have various rights that help you settle your damage fairly and completely. Here you will learn which claims you can assert and how to enforce them correctly:

1
Engaging an independent car appraiser
As the injured party, you have the right to engage an independent car appraiser, even if the at-fault party’s insurance wants to appoint an expert. Especially for damages over €750, it is worthwhile to use an independent appraiser who also considers aspects such as depreciation and loss-of-use compensation.
2
Choice between a replacement car and cash compensation for loss of use
After an accident, you have the choice to either receive a rental car or compensation for loss of use. The amount is based on the duration of the repair and can be provided as a rental car or a cash payment.
3
Mobility despite vehicle damage
If your vehicle is to be repaired after a non-fault accident, you may be entitled to a free rental car. If you can demonstrate the need (e.g., for commuting), the rental car costs are usually fully covered.
4
In cases of personal injury – you are entitled to compensation for pain and suffering
For personal injuries suffered, you are entitled to compensation for pain and suffering. The amount of compensation is determined based on the severity of the injury. A medical certificate helps to establish the amount of compensation.
5
Legal support
If legal disputes arise, you can rely on professional assistance. In many cases, experienced appraisers are sufficient to assert your claims. If a lawyer becomes necessary, a specialist attorney from our network will support you, with the costs covered by the at-fault party’s insurance.
